Regulations, litigation force cancellation of Texas coal-fired power plant construction

Opponents of the coal industry won a victory last week when it was?announced that the White Stallion coal-fired power plant in Matagorda County,?Texas suspended development, partly due to litigation costs and potential federal environmental regulations.

?We have decided to ask the Travis County Court for a stay in the litigation against our ? air permit through December of this year,? Randy Bird, COO for White Stallion,?told STATEIMPACT TEXAS. ?Our air permit extension expires then. If the stay is granted, we will not commence construction while the stay is in effect.?

For years, the coal plant has been the target of environmental groups. Activists have worked to shut down other coal power projects throughout the state as well, and there are no major traditional coal plants planned for construction in Texas.

?After suffering numerous setbacks ? White Stallion has finally seen the writing on the wall,? said Austin attorney Tom Weber, lead counsel at the Environmental Defense Fund who worked in court to stop White Stallion. ?This is a big win for clean air in Texas and for the Environmental Defense Fund.?

Massive protest movement emerges against Islamists in Bangladesh

A protest that has at times swelled into the hundreds of thousands entered its ninth day today in Bangladesh?s capital, touched off by the outcome of a war crimes trial.

?God is Great,? cried out Abdul Qader Mollah, as he was sentenced to life behind bars on Feb. 5 in Bangladesh?s controversial war crimes tribunal. Known as the "butcher of Mirpur," Mr. Mollah was convicted of heinous?crimes committed in 1971 during the country?s blood-soaked independence struggle from Pakistan. He has also been one of the leaders of the largest Islamist party here, the Jamaat-e-Islami.?

After the sentencing, protesters gathered in downtown Dhaka, crying foul that Mollah had not received the death sentence. This soon galvanized a vibrant protest movement against the ongoing influence of conservative, politicized Islam in one of the world's most populous Muslim nations.?

?The current movement is aimed very explicitly at the Jamaat's role in 1971,? says Zafar Sobhan, editor of the Dhaka Tribune.?But ?it was clear that the future that the youths protesting ... envision is one without Islamist politics, returning to Bangladesh's secular roots, and recognition that religion-based politics had poisoned the society.

?They don't want to see the Jamaati-style Islamism either gain further currency in the society or more power politically,? he says.

Crowds continued to grow all week after the verdict. Soon a junction previously known simply as Shahbagh had become "Shahbagh Square," in reference to Tahrir.?The calls of the protest morphed from macabre lynched effigies to calls for Jamaat-e-Islami (JI) to be banned and associated businesses boycotted.

?Us pushing for the death sentence is the tip of the iceberg; this is a way to begin to unravel religion from politics,? says founding protester and blogger Asif Moihuddin, who was recently stabbed?by Islamist thugs because of the content of his blog.

The 1971 independence struggle pitted indigenous Bengali identity against those wishing to remain a part of Pakistan, a country founded with an Islamic identity.?

?JI represents two things in Bangladesh, says Mr. Sobhan. ?The first is their Islamist political philosophy. The second is their role, both as a party and individually, as collaborators with the Pakistan Army in 1971,? and as such, the current protests have drawn on a potent secular patriotism.

The protests ?are not an antireligious movement; we are not against Islam,? says Mr. Moihuddin. ?We are against intimidation in the name of Islam and religion interfering in politics.?

For their part, the JI have called the protests ?fascist in nature,? in a recent press release.

"Of late we have learnt that the demonstrators are planning to attack commercial and philanthropic organizations having distant relationships with Jamaat,? says JI spokesman Abdur Razzaq. He also worries that?"the judges of the tribunal will be intimidated" by the protest.

As for calls to disband his party, Mr. Razzaq sees politics at play: "This?idea was first floated by a partner of the ruling coalition with communist/socialist leanings."

But there are some indications that the protesters are attempting to avoid co-option from political parties. Last Wednesday, a ruling party politician was pelted with bottles when he attempted to address the crowd. ?I don't want the politicians here, they are poison,? says protester Sadab Hossein.

?This verdict gave us an opportunity to hold both the government and JI accountable to the people on an issue we can assemble round,? says Moihuddin. ?If we don?t stop them now, who?s to say where it ends.?

He insists he will continue to protest at Shahbagh, despite receiving death threats.

There are already indications that the ongoing disruption could touch off violence. Counter-riots from JI's student wing, known as Shibir, have broken out, with live ammunition, Molotov cocktails, and running battles with police in other parts of the city.

Texas utility member leaves amid electric supply debate

HOUSTON (Reuters) - Texas Public Utility Commissioner Rolando Pablos said Thursday he will leave the agency March 1, leaving just two commissioners to continue working to find ways to entice new electricity generation to the state to avoid the rising prospect of rolling outages.

In a statement, Pablos said his objective had been to strengthen the state economy "through the application of fair, transparent, and predictable regulation" in the electricity and telecommunication areas.

The PUC is working with the state grid operator to address a looming shortage of electric capacity in the state that increases the likelihood of rolling outages.

The two other commissioners, Donna Nelson and Ken Anderson, are divided over how to send the right price signals to attract new generation without huge market changes or dramatically higher costs for power in the Electric Reliability Council of Texas (ERCOT), the state's primary grid.

While complimentary of Pablos' talent, one PUC observer said it did not appear he had a long-term interest in the complex electric issues facing the state's deregulated market.

"He came from outside the industry to such an extent that the learning curve with everything going on was really severe," said John Moore, a principal with Stratus Energy Group of Austin.

"Over the last few months, it has become apparent that he was not participating in discussions at open meetings to the level that you might expect of someone with a long-term vision," Moore said.

Pablos was appointed to the PUC in September 2011 by Texas Governor Rick Perry. His term was due to end September 1.

The governor's office did not immediately comment on how quickly it might appoint a new commissioner to replace Pablos.

A third commissioner likely won't be appointed until after the Texas Legislature adjourns in late May since appointments made during the session require confirmation before the session ends.

The next commissioner will face decisions that will shape the Texas power market for years to come.

"Whoever is appointed could be the deciding factor as to what market structure the PUC ultimately adopts and perhaps the potential profitability of power plants in ERCOT," said Paul Patterson, an energy analyst at Glenrock Associates of New York.

Pablos' departure will not slow the current pace of work at the PUC to address the issue of resource adequacy.

On Thursday, the commission asked for more information from ERCOT related to potential solutions and suggested more time will be needed to allow public comment and workshops this spring.

Canada's Effort to Unify Accounting Bodies Seeing Mixed Results

Canada's professional accountants' effort to unite its disparate certification bodies under a new national accounting body, the Chartered Professional Accountants of Canada (CPA Canada), is seeing mixed results.?

CPA Canada was officially established January 1 with the aim of unifying the accounting profession for Canada, which would include the issuance of the Chartered Professional Accountant (CPA) designation.?

?

On its website, CPA Canada says its vision for the professional designation is: "To be the pre-eminent, internationally recognized Canadian accounting designation and business credential that best protects and serves the public interest."

?

CPA Canada, which has been in the project stage for several years, says "a single voice representing as many as 170,000 Canadian members would more effectively represent member interests with respect to domestic policy, legislation, and regulatory issues affecting the accounting profession."

?

"By drawing on the best of existing programs, we will create the certification program needed to produce Canada's pre-eminent professional accountants. The new program will:

  • Be ??and be recognized ??as at least as rigorous as all current programs.
  • Require an undergraduate degree and specific subject area coverage for admission to the professional education program.
  • Include a graduate-level professional education program developed nationally and delivered regionally.
  • Culminate in a comprehensive multi-day common final evaluation.
  • Include a part time, accelerated bridging program to appeal to the broadest possible group of potential candidates.
  • Appeal to employers for its development of accountancy and business skills in a high quality, cost effective professional program.
  • Meet or exceed the requirements of the leading global accounting bodies, ensuring the new profession can maintain existing, and establish, new Mutual Recognition Agreements (MRAs)."

Currently, Canada has over forty independent accounting bodies across its ten provinces and three territories.

A sixteen-member board of directors has been established for CPA Canada and includes regional representatives as well as representation from the accounting organizations participating in the unification.

  • Academic prerequisites for admission to the CPA professional education program.?
  • A graduate level CPA professional education program.?
  • Evaluations, including a common comprehensive final evaluation.?
  • Relevant practical experience."

The CPA Canada board has appointed Kevin Dancey, FCPA, FCA, as president and CEO of CPA Canada. He and Joy Thomas, FCMA, who assumes the role of executive vice president, will lead the new national organization.?

Dancey told AccountingWEB that the CPA designation awarded in Canada will be "substantially equivalent" to that of a certified public accountant, or CPA, in the United States.

?

But there is discord in the unification process, as only two of the three national accounting bodies ??Canadian Institute of Chartered Accountants (CICA) and Certified Management Accountants of Canada (CMA Canada) ??are supporting CPA Canada. The third national accounting organization, Certified General Accountants of Canada (CGA-Canada), dropped out of the unification discussions after initially taking part in the process.?

CGA-Canada President and CEO Anthony Ariganello told AccountingWEB, "CGA-Canada has always believed that there is value in unification, but we need to ensure fairness and equity for CGAs. At this time, we feel that there are a number of issues not being addressed in discussions, such as the varying use of legacy designations, the commitment to minority protection, and the governance structure of the new body."

In addition, acceptance of CPA Canada is complicated by the fact that a change in professional designation is a matter of provincial jurisdiction under the Canadian Constitution, so the decision is up to each province's CICA, CMA Canada, and CGA-Canada membership to individually decide the matter.?

At its inaugural meeting on January 15, CPA Canada approved the applications of CPA Quebec and the Institute of Chartered Accountants of Ontario (ICAO) to become Organization Members of CPA Canada. That brought CPA Canada individual members to more than 70,000, according to a January 23 posting on CPA Canada's website.

Indicative of the confusion that has enveloped the process, CPA Quebec's membership includes CGA members from its province as well as CICA and CMA members.?

?

Several other provincial CGA organizations are still discussing joining, according to CPA Canada. For example, "on January 14, the Certified General Accountants Association of New Brunswick (CGANB) issued an announcement to its members stating that the CGANB Board of Governors has chosen to re-enter discussions with the New Brunswick Institute of Chartered Accountants (NBICA) and CMA New Brunswick (CMANB) to support the unification of the accounting profession currently taking place across Canada."?

But CGA Ontario, which is in the nation's most populated province, said in a January 30 statement posted on its website that its board of directors doesn't support joining CPA Canada: "Over the last few weeks, more than 500 CGAs participated in member forums. When CGAs heard the facts, they overwhelmingly rejected the idea of merging with a body that would not commit to treating all members fairly and equally."

A war without end, with Earth's carbon cycle held in the balance

Feb. 13, 2013 ? The greatest battle in Earth's history has been going on for hundreds of millions of years -- it isn't over yet -- and until now no one knew it existed, scientists reported Feb. 13 in the journal Nature.

In one corner is SAR11, a bacterium that's the most abundant organism in the oceans, survives where most other cells would die and plays a major role in the planet's carbon cycle. It had been theorized that SAR11 was so small and widespread that it must be invulnerable to attack.

In the other corner, and so strange-looking that scientists previously didn't even recognize what they were, are "Pelagiphages," viruses now known to infect SAR11 and routinely kill millions of these cells every second. And how this fight turns out is of more than casual interest, because SAR11 has a huge effect on the amount of carbon dioxide that enters the atmosphere, and the overall biology of the oceans.

"There's a war going on in our oceans, a huge war, and we never even saw it," said Stephen Giovannoni, a professor of microbiology at Oregon State University. "This is an important piece of the puzzle in how carbon is stored or released in the sea."

Researchers from OSU, the University of Arizona and other institutions have just outlined the discovery of this ongoing conflict, and its implications for the biology and function of ocean processes. The findings disprove the theory that SAR11 cells are immune to viral predation, researchers said.

"In general, every living cell is vulnerable to viral infection," said Giovannoni, who first discovered SAR11 in 1990. "What has been so puzzling about SAR11 was its sheer abundance; there was simply so much of it that some scientists believed it must not get attacked by viruses."

What the new research shows, Giovannoni said, is that SAR11 is competitive, good at scavenging organic carbon, and effective at changing to avoid infection. Because of that, it thrives and persists in abundance even though it's constantly being killed by the new viruses that have been discovered.

The discovery of the Pelagiphage viral families was made by Yanlin Zhao, Michael Schwalbach and Ben Temperton, OSU postdoctoral researchers working with Giovannoni. They used traditional research methods, growing cells and viruses from nature in a laboratory, instead of sequencing DNA from nature. The new viruses were so unique that computers could not recognize the virus DNA.

"The viruses themselves, of course, appear to be just as abundant as SAR11," Giovannoni said. "Our colleagues at the University of Arizona demonstrated this with new technologies they developed for measuring viral diversity."

SAR11 has several unique characteristics, including the smallest known genetic structure of any independent cell. Through sheer numbers, this microbe has a huge role in consuming organic carbon, which it uses to generate energy while producing carbon dioxide and water in the process. SAR11 recycles organic matter, providing the nutrients needed by algae to produce about half of the oxygen that enters Earth's atmosphere every day.

This carbon cycle ultimately affects all plant and animal life on Earth.

Eric Church leads ACM Awards nominations

NASHVILLE, Tenn.

They don't call him Chief for nothing: Eric Church is the top nominee at this year's Academy of Country Music Awards.

The rising country music star has seven nominations for the April 7 awards show in Las Vegas. Hunter Hayes is next with six, followed by Taylor Swift and Miranda Lambert at five apiece.

Swift and Lambert are up for the academy's top honor ? entertainer of the year ? with Lambert's husband, Blake Shelton, Jason Aldean and Luke Bryan. Swift is going for her third straight win in that category.

Shelton and Bryan will co-host the broadcast, to air live on CBS from the MGM Grand.

Along with naming nominees in a series of videos online Wednesday morning, the academy also awarded trophies in the three new artist categories. Jana Kramer is the new female vocalist of the year, Brantley Gilbert is the new male vocalist winner and Florida Georgia Line took new vocal duo or group, as voted by fans. Those three acts will now compete for new artist of the year.

Fans will continue to have a say in that category and entertainer of the year. Fans can vote in those categories beginning March 25 at http://VoteACM.com.

Church's "Chief" is up for album of the year along with Swift's "Red," Bryan's "tailgates & tanlines," Carrie Underwood's "Blown Away" and Little Big Town's "Tornado." Jay Joyce scored a rare double in the category: He produced the Church and Little Big Town albums and will take home a trophy if either wins. He's also up for producer of the year.

Church is also up for male vocalist of the year with 2012 winner Shelton, Bryan, Aldean and Toby Keith. Lambert will be going for her fourth straight female vocalist of the year award with Swift, Underwood, Martina McBride and Kacey Musgraves, a newcomer who earned four nominations.

Others with four nominations include Bryan and Little Big Town. That quartet is up for vocal group of the year with Lady Antebellum, which has won the award three straight times, Zac Brown Band, Eli Young Band and The Band Perry.

Surprise 2012 vocal duo winner Thompson Square is nominated in that category again along with Sugarland, Big & Rich, Florida Georgia Line, and Love and Theft.

Church also is nominated in the song and single of the year categories for "Springsteen." Lambert's "Over You," Hayes' "Wanted," Eli Young Band's "Even If It Breaks Your Heart" and Lee Brice's "A Woman Like You" round out the song of the year category.

Lambert, EYB and Hayes join Church in the single of the year category with LBT's "Pontoon."

(AP) ? Michael Vick took a significant pay cut to stay with the Philadelphia Eagles and compete for a starting job.

The four-time Pro Bowl quarterback agreed Monday to a restructured three-year contract with the Eagles, just two seasons after signing a $100 million extension that included $35.5 million in guaranteed money. The new deal is essentially for one-year, however.

A source familiar with the contract said Vick could earn up to $10 million in 2013 if he meets all his performance incentives, and the team will void the remaining two years on March 15. That person spoke on condition of anonymity because the terms haven't been released.

Vick was slated to earn about $16 million next season, including a $3 million roster bonus. He lost his starting job to rookie Nick Foles last season, but new coach Chip Kelly will give him a chance to win it back.

"I am grateful and proud to be a Philadelphia Eagle," Vick wrote on Twitter. "My heart is in Philly and this community is important to me."

Vick had a breakout year in 2010, leading the Eagles to the NFC East title, winning The Associated Press Comeback Player of the Year award and starting in the Pro Bowl. But he's battled injuries and inconsistency the last two years.

"What I look at is skillset first and foremost," Kelly said. "What he can do, how he can throw the football, how he can beat people with his feet. There are a lot of different factors he has. And you have to look at the landscape for other quarterbacks. I guess the best way I can put this is I agree there is a change of scenery going on here. For Michael Vick, there is a change of scenery, but not a change of address."

Since the Eagles hired Kelly to replace Andy Reid, there's been plenty of speculation about which quarterback will run his aggressive, up-tempo offense. Though Kelly has been effusive in his praise for Foles, the slow-footed, pocket-passer isn't an ideal fit for a zone-read offense. Kelly, though, said he will cater his offense around his players' strengths. After all, he's known for being an offensive innovator who had tremendous success at Oregon.

"I don't think what we do offensively can be said in one or two words that we're either this or we're this," Kelly said. "We're an equal-opportunity scoring operation. Whether we run the ball over the goal line or throw the ball over the goal line really doesn't bother me, it's how do we move the football.

"There have been games we've had to throw it in our league 50 times and there are games we have to run it 50 times. You need to be built for the long haul. There is a skill set that Nick has that really excites me about him. I think we've got an older quarterback in Michael who is 32 now, and have a younger guy in Nick who is going into his second year, and I think it's the ideal situation for us moving forward this season."

Kelly didn't rule out a trade, however.

"I don't rule anything out, I don't rule anything in," he said. "But I know moving forward we, as an organization, had to make a decision on what to do with Michael, and I want Michael to be part of this team."

Vick has missed 11 games because of injuries over the last three seasons. He sustained a concussion in Week 10 last year and Reid decided to let Foles play the rest of the way because the Eagles were in last place. They finished 4-12.

Vick returned to start the season finale against the New York Giants because Foles was hurt. He finished the year with 2,362 yards passing, 12 touchdowns and 10 interceptions, and also lost five fumbles.

A former No. 1 overall pick by Atlanta, Vick was signed by Philadelphia in 2009 after missing two years because he was in federal prison. He came in as the No. 3 quarterback behind Donovan McNabb and Kevin Kolb.

After McNabb was traded and Kolb was injured in the season opener in 2010, Vick took over and was outstanding. He had career highs in yards passing (3,018), completion percentage (62.6), touchdowns passing (21), touchdowns rushing (9) and passer rating (100.2).

But he hasn't come close to playing up to that level. There are questions, of course, about his durability and his age ? Vick will be 33 in July.

"He's younger than (Dallas quarterback) Tony Romo, and he's right about the same age as (Giants quarterback) Eli Manning," Kelly said. "The only reason I say that is because I told Michael that this morning, and he didn't know."

Vick is undersized and stubborn about playing it safe. He usually takes on tacklers instead of running out of bounds and dives headfirst instead of sliding.

"I looked at the films, and studied the tape. When you look at Michael, it's his toughness. That cannot be overrated at all," Kelly said. "We looked at his skill set. He still has that skill set. He can still throw the football.

"He's got an unbelievable release, and it's our job as coaches to make sure he can get the ball out quickly."

The Eagles scored just 280 points last season as they endured an eight- and a three-game losing streak. Only Arizona (250) scored fewer in the NFC.

When asked whether Vick or Foles would work with the first-team offense in training camp, Kelly smiled and quickly showed he's going to be able to handle the Philadelphia media just fine.

"We'll go alphabetical," he said with a grin. "First name? Last name? We'll flip a coin."

A very important component of battery life is the care the skipper takes. That makes answers to this question somewhat moot. Recharging, checking water levels, etc. is very important to battery life. Some skippers have solar, some generators, some only engines. It's really a hard question to answer the way you put it. With good maintenance, well over 3 years should be the norm, easily.

I bought 6 marine deep cycles (85 ah) from costco for $480, 510 ah total and this is my house bank. Solar and windgen, never run the diesel for charging, well maybe 10 times in the last 3 1/2 years. I wasnt sure what to expect from them but they've been great. I checked the fluid in them for the first time a couple months ago and added a pint total. When they do die I wanna add more ah's, so I'll look to see what better value is available. I have reefer, auto pilot, LCD/DVD tv, stero, LED nav lights.

A good lead acid battery will give you about 5 years of service under good conditions. I have seen some last 7 or 8 and some only 2 but 5 is the rule of thumb.

Where I work we have started using SAFT batteries instead of lead acid an they are projected to last over 10. One issue is the newer batteries pull a crap ton of amps when recharging compared to lead acid. If your charge rsystem is not up to the extra load many headache may result.

Had a pair of Trojan L-16's on my last boat that were used hard for 3-1/2 years (often more than 50% discharged) cruising anchoring most of the time. After that they still had enough life for liveaboard and weekend cruising for another 3 years. They never died catastrophically, but the capacity was very low at the end.
